Terms & Conditions
Last updated: August 2026
These Terms & Conditions govern the use of YOTAVIX services and form the agreement between YOTAVIX ("we", "us", or "our") and the client ("you" or "client"). By engaging YOTAVIX for a project, you agree to these terms.
SERVICES
YOTAVIX provides website design, website development, landing pages, business websites, e-commerce development, website deployment, performance optimization, SEO foundations, and related digital services.
The exact scope of each project will be based on the package selected, project proposal, or written agreement between YOTAVIX and the client.
Any work outside the agreed scope may require an additional fee.
PROJECT SCOPE
Before development begins, YOTAVIX and the client will agree on the general project requirements, features, pages, functionality, and deliverables.
Requests that materially change the original scope may be treated as additional work and may result in additional charges or an adjusted timeline.
CLIENT RESPONSIBILITIES
The client is responsible for providing accurate business information, logos, images, written content, contact information, product information, and other materials required for the project.
The client must have the necessary rights and permissions to use any content, images, trademarks, logos, or other materials supplied to YOTAVIX.
Delays in providing required information or approvals may affect the project timeline.
DESIGN & REVISIONS
The number of revision rounds included in a project depends on the selected package or agreed project scope.
A revision means a reasonable change to an existing design or content direction. A completely new design direction or substantial change in scope may be considered additional work.
YOTAVIX will work with the client to achieve the agreed design direction and business objectives.
PAYMENT
Project pricing is displayed on the YOTAVIX website where applicable or will be provided through a custom quotation.
For custom projects, the final price will be agreed upon before development begins.
YOTAVIX may require an upfront payment before starting development.
Work may be paused if required payments are overdue.
Unless otherwise agreed in writing, payments already made for completed work are non-refundable.
PROJECT TIMELINES
YOTAVIX will provide an estimated project timeline based on the agreed scope.
Project timelines may be affected by:
- delayed client responses
- delayed content or assets
- additional revisions
- changes in project requirements
- third-party services
- hosting or domain issues
- payment delays
- circumstances outside YOTAVIX's reasonable control
We will make reasonable efforts to communicate significant delays.
HOSTING & DOMAIN
Where hosting is included in the selected package, YOTAVIX will arrange and manage the website hosting for the included period specified in the package.
Hosting is provided through third-party infrastructure providers.
Hosting availability, uptime, pricing, limitations, and technical conditions may be subject to the policies of the underlying hosting provider.
Domain registration is separate unless explicitly stated otherwise in the project agreement or package.
After the included hosting period ends, the client may choose to continue hosting through YOTAVIX under the applicable renewal terms or move the website to another hosting provider.
YOTAVIX will not intentionally prevent the client from moving their website to another hosting provider, subject to any outstanding payments and technical requirements.
WEBSITE OWNERSHIP & SOURCE CODE
Once the project has been fully paid for, the client receives ownership of the final website deliverables created specifically for the project, subject to third-party licenses, open-source licenses, fonts, stock assets, plugins, APIs, and other third-party components.
Where applicable, the client may receive the website source code after full payment.
YOTAVIX retains ownership of its pre-existing tools, reusable components, internal frameworks, development methods, templates, and other proprietary materials that were not created exclusively for the client.
THIRD-PARTY SERVICES
Websites may depend on third-party services such as:
- hosting providers
- domain registrars
- payment gateways
- analytics platforms
- email services
- maps
- APIs
- fonts
- plugins
- databases
- external software
Third-party services may have their own fees, terms, limitations, availability, and privacy policies.
YOTAVIX is not responsible for outages, policy changes, pricing changes, or failures caused by third-party providers.
SEO
Where SEO is included, YOTAVIX will implement agreed technical and on-page SEO practices appropriate to the selected package.
SEO services may include technical SEO foundations, metadata, structured content, performance improvements, indexing configuration, and other agreed optimizations.
SEO does not guarantee specific Google rankings, traffic levels, search positions, leads, sales, or other business results.
Search engine algorithms and ranking factors are controlled by third parties and may change without notice.
PERFORMANCE
YOTAVIX aims to deliver fast, responsive, and technically optimized websites.
Performance can depend on hosting infrastructure, third-party scripts, images, APIs, client-provided content, browsers, devices, and other external factors.
Performance optimization does not guarantee a specific Lighthouse score or identical performance across every device and network.
E-COMMERCE PROJECTS
E-commerce projects may require additional infrastructure such as:
- databases
- payment gateways
- product management systems
- order management
- authentication
- transactional email
- hosting
- third-party APIs
- security services
These costs may be separate from the development fee unless explicitly included in the project quotation.
Payment gateway transaction fees and third-party service fees are the responsibility of the client unless otherwise agreed.
CONTENT & LEGAL COMPLIANCE
The client is responsible for ensuring that their website content, business practices, products, services, privacy policies, terms, refund policies, disclaimers, and other legal requirements comply with the laws and regulations applicable to their business.
YOTAVIX provides website development services and does not provide legal, tax, financial, or regulatory advice.
WEBSITE LAUNCH
A website will be considered ready for launch when the agreed deliverables have been completed and the website is functioning substantially according to the agreed project scope.
The client is responsible for reviewing the final website and notifying YOTAVIX of any reasonable issues covered by the agreed scope.
POST-LAUNCH SUPPORT
Post-launch support is provided according to the package selected or the terms agreed for the project.
Support covers reasonable technical issues related to the delivered website.
It does not automatically include:
- new pages
- new features
- redesigns
- major content changes
- new integrations
- additional functionality
- ongoing SEO campaigns
Such work may be quoted separately.
CANCELLATION
Either party may request cancellation of a project.
If the client cancels after work has started, fees may apply for work already completed, resources committed, or third-party costs incurred.
YOTAVIX may suspend or terminate a project if the client repeatedly fails to provide required information, approvals, or payments.
PORTFOLIO USE
Unless otherwise agreed in writing, YOTAVIX may display the completed website or selected project visuals in its portfolio, website, presentations, and marketing materials.
If a client requires confidentiality or does not want their project displayed publicly, this should be agreed upon before the project begins.
WARRANTIES & LIMITATION OF LIABILITY
YOTAVIX will make reasonable efforts to deliver services professionally and according to the agreed project scope.
However, YOTAVIX does not guarantee that a website will be completely free of errors, uninterrupted, permanently available, or produce a specific business result.
To the maximum extent permitted by applicable law, YOTAVIX will not be liable for indirect, incidental, consequential, or business losses arising from the use or inability to use the website or third-party services.
